VERKLARING MODELRECHTEN / PORTRETRECHTEN

Namens Nora Maria B.V.

1. Definities (NEDERLANDS)

1. Model: De persoon die aan de fotoshoot deelneemt en herkenbaar in beeld komt.

2. Nora Maria B.V.: De partij die de opdracht uitvoert. Het kan zijn dat een fotograaf of medewerker namens Nora Maria B.V. de foto’s maakt.

3. Fotoshoot: De door het Model gekozen en gereserveerde fotoshoot, waarvoor deze verklaring van toepassing is.

4. Beeldmateriaal: Alle foto’s (en/of video’s) die tijdens de fotoshoot van het Model worden gemaakt.

5. Klanten: Opdrachtgevers of afnemers van Nora Maria B.V. waarvoor (onder andere) foto’s worden gemaakt of ter beschikking worden gesteld.

2. Doel en reikwijdte (NEDERLANDS)

• Deze verklaring regelt het gebruik van portretten (foto’s/video’s) van het Model voor publicatie op social media kanalen van de Klant van Nora Maria B.V.

• Het doel is om toestemming te verkrijgen van het Model voor het gebruik van diens portret door zowel Nora Maria B.V. als haar Klant, voor publicatie op social media.

3. Afstand van portretrecht (NEDERLANDS)

1. Het Model verleent hierbij aan Nora Maria B.V. en haar Klant toestemming om het Beeldmateriaal te gebruiken, te publiceren en te verveelvoudigen voor promotie- en publicatiedoeleinden op social media (zoals Facebook, Instagram, LinkedIn, TikTok). Het is nadrukkelijk niet toegestaan deze beelden te gebruiken voor websites, drukwerk of andere commerciële uitingen die buiten de reikwijdte van social media vallen, tenzij hiervoor vooraf en schriftelijk aanvullende toestemming van het Model is verkregen.

2. Deze toestemming geldt voor onbepaalde tijd en is niet beperkt tot een bepaalde regio.

3. Het Model doet afstand van het recht om zich te verzetten tegen het gebruik van het portret voor de in deze verklaring beschreven socialmedia-doeleinden, tenzij er redelijke gronden zijn waardoor publicatie onrechtmatig is (bijvoorbeeld in geval van reputatieschade of misleiding).

4. Gebruik door derden (Klanten) (NEDERLANDS)

1. Deze overeenkomst verleent uitsluitend aan Nora Maria B.V. en de specifiek genoemde Klant(en) het recht om de foto’s te gebruiken voor de hierboven genoemde doeleinden (social media).

2. Indien andere Klanten van Nora Maria B.V. dezelfde beelden willen gebruiken voor hun eigen commerciële uitingen of (online/offline) publicaties, zullen deze Klanten een eigen overeenkomst met het Model moeten sluiten. Deze verklaring geldt dus niet als toestemming richting andere derde partijen.

5. Geen aanvullende vergoeding (NEDERLANDS)

1. Nora Maria B.V. is geen (aanvullende) vergoeding verschuldigd voor het gebruik van het portret, tenzij anders en schriftelijk overeengekomen.

2. Het Model ontvangt, voor zover van toepassing, de eventueel vooraf afgesproken vergoeding of onkostenvergoeding.

6. Aansprakelijkheid (NEDERLANDS)

1. Nora Maria B.V. zal het Beeldmateriaal niet onrechtmatig of opzettelijk schadelijk gebruiken.

2. Nora Maria B.V. is niet aansprakelijk voor het gebruik van het Beeldmateriaal door derden (waaronder onrechtmatig kopiëren en verspreiden), tenzij sprake is van grove nalatigheid of opzet aan de kant van Nora Maria B.V.

7. Privacy & Persoonsgegevens (NEDERLANDS)

1. De persoonsgegevens van het Model (zoals naam, e-mailadres of telefoonnummer) worden uitsluitend gebruikt voor de organisatie van de fotoshoot en communicatie omtrent deze verklaring.

2. Nora Maria B.V. zal deze gegevens niet aan derden verstrekken zonder toestemming van het Model, behalve wanneer dit wettelijk verplicht is.

8. Automatische akkoordverklaring (geen handtekening vereist) (NEDERLANDS)

1. Door het invullen van het aanmeldformulier of het reserveren van een tijdslot voor de fotoshoot via [bijv. jullie website of online booking tool], verklaart het Model zich automatisch akkoord met de inhoud van deze verklaring.

2. Het Model bevestigt kennis te hebben genomen van en in te stemmen met de inhoud van deze verklaring.

3. Het is de verantwoordelijkheid van het Model om deze verklaring door te nemen voordat hij/zij zich aanmeldt of deelneemt aan de fotoshoot.

9. Herroeping (NEDERLANDS)

1. Het Model kan deze toestemming uitsluitend intrekken als er bijzondere en zwaarwegende gronden zijn (zoals ernstige schade aan privacy of reputatie).

2. Een verzoek tot herroeping dient schriftelijk (bijv. per e-mail) te worden ingediend, waarna Nora Maria B.V. en het Model in overleg treden over de mogelijkheden en gevolgen van intrekking.

10. Overige bepalingen (NEDERLANDS)

1. Op deze verklaring is het Nederlands recht van toepassing.

2. Eventuele geschillen voortvloeiend uit of samenhangend met deze verklaring zullen in eerste instantie aan de bevoegde rechter in het arrondissement [bijv. woon- of vestigingsplaats van Nora Maria B.V.] worden voorgelegd.

Door het bevestigen“Ik ga akkoord met de portretrechtverklaring” of door het bevestigen van een tijdslot voor de fotoshoot, geeft het Model te kennen dat hij/zij deze verklaring zorgvuldig heeft gelezen, begrepen en akkoord is met de inhoud ervan.

1. Definitions (ENGLISH)

1. Model: The person participating in the photoshoot and who is recognizable in the images.

2. Nora Maria B.V.: The party executing the assignment. It may be that a photographer or employee on behalf of Nora Maria B.V. takes the photographs.

3. Photoshoot: The photoshoot chosen and booked by the Model, to which this statement applies.

4. Visual Material: All photographs (and/or videos) taken of the Model during the photoshoot.

5. Clients: Clients or customers of Nora Maria B.V. for whom (among other things) photos are taken or made available.

2. Purpose and Scope (ENGLISH)

• This statement governs the use of portraits (photos/videos) of the Model for publication on the social media channels of Nora Maria B.V.’s Client.

• The aim is to obtain the Model’s permission for the use of their portrait by both Nora Maria B.V. and its Client, specifically for social media publication.

3. Waiver of Portrait Rights (ENGLISH)

1. The Model hereby grants Nora Maria B.V. and its Client permission to use, publish, and reproduce the Visual Material for promotional and publication purposes on social media (such as Facebook, Instagram, LinkedIn, TikTok). It is expressly not permitted to use these images for websites, printed materials, or other commercial applications beyond social media unless prior written consent is obtained from the Model.

2. This permission is granted for an indefinite period and is not restricted to any particular region.

3. The Model waives the right to object to the use of their portrait for the social media purposes described in this statement, unless there are reasonable grounds that make publication unlawful (for instance, in case of damage to one’s reputation or deception).

4. Use by Third Parties (Clients) (ENGLISH)

1. This agreement grants permission exclusively to Nora Maria B.V. and the specifically named Client(s) to use the photos for the aforementioned purposes (social media).

2. Should other Clients of Nora Maria B.V. wish to use the same images for their own commercial or (online/offline) publications, these Clients must enter into a separate agreement with the Model. This statement does not serve as consent for other third parties.

5. No Additional Compensation (ENGLISH)

1. Nora Maria B.V. is not required to pay (additional) compensation for the use of the portrait, unless otherwise agreed in writing.

2. If applicable, the Model will receive any previously agreed fee or reimbursement of expenses.

6. Liability (ENGLISH)

1. Nora Maria B.V. will not use the Visual Material unlawfully or intentionally in a harmful manner.

2. Nora Maria B.V. shall not be liable for the use of the Visual Material by third parties (including unlawful copying and distribution), unless there is gross negligence or intent on the part of Nora Maria B.V.

7. Privacy & Personal Data (ENGLISH)

1. The Model’s personal data (such as name, email address, or telephone number) will only be used for organizing the photoshoot and communication regarding this statement.

2. Nora Maria B.V. will not disclose this information to third parties without the Model’s consent, unless legally required.

8. Automatic Agreement (No Signature Required) (ENGLISH)

1. By completing the registration form or booking a time slot for the photoshoot via [e.g., your website or online booking tool], the Model automatically agrees to the content of this statement.

2. The Model confirms that they have read and agree to the content of this statement.

3. It is the Model’s responsibility to review this statement before registering or participating in the photoshoot.

9. Revocation (ENGLISH)

1. The Model may only withdraw this consent in the case of special and compelling circumstances (such as severe damage to privacy or reputation).

2. A request for withdrawal must be submitted in writing (e.g., by email), after which Nora Maria B.V. and the Model will consult on the possibilities and consequences of such withdrawal.

10. Other Provisions (ENGLISH)

1. This statement is subject to Dutch law.

2. Any disputes arising from or connected with this statement will initially be brought before the competent court in the district where Nora Maria B.V. is located.

By confirming “I agree with the portrait rights statement” or confirming a time slot for the photoshoot, the Model acknowledges having carefully read, understood, and agreed to the content of this statement.
